• Public Information Requests
    The Communications Department handles all public information requests for the district. All requests for public information are handled in accordance with the Texas Public Information Act, Texas Government Code §552.001. Requests for public information should be submitted in writing by fax, e-mail, U.S. mail, or in person. This procedure allows the Communications Department to accurately document the date each request is received and respond in writing within the required 10 business day time period. Requests must ask for records or information already in existence. The TPIA does not require the district to create new information. 
     
    All Open Records requests should be referred to the Communications Department immediately upon receipt.

    NOTICE: Effective January 1, 2017, EMS ÀÏ˾»ú¸£ÀûÉç will begin charging for all copies and costs incurred in responding to requests under the Texas Public Information Act in accordance with Subchapter F of Chapter 552 of the Texas Government Code and Rules of the Texas Attorney General. In addition to exceptions noted in law, local exceptions may be made for general requests for student or faculty directories that do not require additional programming or manipulation of data.
     
    Documents which are deemed public information will be made available for review and/or retrieval. For persons requesting copies of the information, the district charges $.10 per copy. Labor costs for processing a request are billed at $15 an hour and programming fees are $28.50 an hour, per Attorney General Rules. For requests involving copies and labor/programming fees in excess of $40, the district will send an itemized statement and ask for a response in writing, verifying that the requestor accepts the estimate. For detailed information about the Texas Public Information Act, please visit the Office of the Attorney General (OAG) . 
     
    NOTICE: As of December 11, 2017, EMS ÀÏ˾»ú¸£ÀûÉç no longer releases student directory information to third-party requestors not identified in Board policy or required by law. The EMS ÀÏ˾»ú¸£ÀûÉç Board of Trustees approved policy revisions that included limiting the disclosure of directory information to specific third-party requesters that are 501(c)(3) organizations. These include:
    • PTAs and PTOs supporting EMS ÀÏ˾»ú¸£ÀûÉç campuses and the district;
    • Booster clubs supporting EMS ÀÏ˾»ú¸£ÀûÉç teams and organizations;
    • Groups supporting the district’s academic programs (such as gifted and talented education, dyslexia/reading services, and Special Education services); and,
    • The Eagle Mountain-Saginaw Education Foundation.

    NOTICE: During the 88th session, the Texas legislature passed HB3033, amending Chapter 552 of the Texas Government Code by adding section 552.0031. The statute is effective September 1, 2023, and clarifies the definition of "business day" to a day other than Saturday or Sunday, a national holiday, or state holiday. 

    Additionally, the new rule requires a governmental body to identify 10 days each calendar year that the governmental body's administrative offices are closed or operating with minimum staffing as nonbusiness days. All other days the administrative offices are closed would be considered "business days" under the new statute.

    After state and national holidays are considered, the following dates will be considered "nonbusiness days" for EMS ÀÏ˾»ú¸£ÀûÉç for the period of September 1, 2023 through December 31, 2023:

    Student Record Requests
    Student record requests fall under the guidelines set forth by the Family Educational Rights and Privacy Act (FERPA). FERPA gives parents certain rights with respect to their children's education records. Parents or eligible students have the right to inspect and review the student's education records maintained by the school. Requests for a transcript or other student records should be directed to the current or last EMS ÀÏ˾»ú¸£ÀûÉç campus your student attended.
